Ramos v. Casey, ___ So. 3d ___, 35 Fla. L. Weekly D2086 (Fla. 5th DCA 9/17/10)
After the trial court entered a default judgment against the defendants, it conducted a trial on the issue of damages. The trial court improperly interjected itself into the trial by interposing objections and dismissing the plaintiff’s case because it was based upon inadmissible hearsay. As a result, the appellate court reversed and remanded for new trial before a different judge.
